Privacy Collection Notice

Purpose of collection

The Residential Tenancies Bond Authority (RTBA, we, us) collects personal information from you in order to:

  • undertake bond lodgment;
  • perform its transfer and repayment functions; and
  • fulfil any other functions under the Residential Tenancies Act 1997 (Act).

The RTBA may also use your personal information for purposes which are ancillary to its functions, including:

  • to provide you with information or advice, answer enquiries, seek feedback on matters, and keep your contact details up to date;
  • to carry out our administrative, planning, quality control and research activities; and
  • to comply with any law, rule, regulation, lawful and binding determination, decision or direction of a regulator, or a court.

Disclosure of personal information

The RTBA may disclose your personal information to:

  • contractors or service providers, including web hosting providers, IT systems administrators, payment processors, data entry service providers, electronic network administrators, and organisations that provide archival, auditing, banking, mailhouse, call centre, delivery, or research services, as well as professional advisors such as accountants, lawyers, business advisors and consultants;
  • other organisations for the purposes of complying with a function, or exercise of a power under the Act, or another law; or
  • a court in the course of any criminal proceedings, or proceedings under the Act; and
  • other organisations, where we are permitted under the Act.

We also supply your de-identified personal information to the Director of Housing for use in research, statistics, and public education.

Access

You may request access to the personal information we hold about you at any time. We will provide you with access to your personal information unless we are permitted by law to refuse your request and consider it is necessary to do so.

Consequences of failing to provide personal information

If you do not provide us with the personal information we have requested, we will not be able to provide you with our services. However, where it is possible assist you without collecting your personal information, for example, if you make a general enquiry, you will not be required to provide your personal information.
